諸外国の同性婚制度は、さまざまなものがあります。
同性婚を法律婚と同旨して取り扱う国
- アメリカ（州により異なります）
- オランダ
- スペイン その他多数
ドメスティック・パートナー制度（申請者に自治体等が福祉や法的保護を与える）
- ハワイ州
- カリフォルニア州 等
日本人が外国人のパートナーと、外国で同性婚をすることは認められています。
法務省でも、（独身）証明書の発行が可能です。
ただし、非常に残念ですが、外国での同性婚の効力は、日本では通用しません（法的効力を有しません）。
よって、同性婚者の権利を最大限保護するため、下記のような契約が有効です。
- 同性パートナーシップ合意契約
- 任意後見契約
→同性パートナーは法定後見の申し立て権がなく、また、後見人に選任される可能性も低い。
- 公正証書遺言
→同性パートナーには、相続権がない。
- 死後事務委任契約
私見!!
日本の制度が、世界から遅れているのは事実です。グローバル化と多様性を認め合う社会の実現を目指すうえで、従来の家族の在り方に対する社会の認識も変わるべきです。とは言え、歴史的な背景に基づく制度や慣習などは中々変わりません。日本が窮屈と感じる人は、自己実現、より快適な生活環境を求め、海外移住など、自分に合った場所を選ぶのも選択肢の一つですし、素晴らしいことではないかと、個人的には考えます。

There are various types of same-sex marriage in foreign countries.
Consider same-sex marriage as legal marriage

Domestic・Partner system(Local & state government provides welfare services & legal support)

Japanese law allows the same-sex couple get married in foreign countries.
Legal department in Japan also issues the certificate of bachelorship to be submitted in foreign countries.
But, unfortunately, even he/she get married in foreign countries, the same-sex marriage cannot be officially approved in Japan. It means, the same-sex marriage couple cannot receive various social services the same way as the official marriage couple can.
To protect the right of same-sex partner, various types of contracts can be made between the couple.
- Same-sex partnership contract
- Guardianship agreement
- Last will and testament etc.
Personal Views!!
The system related to the same-sex marriage in Japan is way behind the world trend. The social awareness toward the same-sex marriage should be changed to catch up with the globalization and to accept the diversity of the world. However, to change the customs and tradition lying in the history normally takes time. If he/she feels uncomfortable living in Japan, living in foreign countries could be one of the many choices to find who you are and to live happily ever after.

Pero, sa kasamaang palad, ang lalaki at babae na kinasal sa ibang bansa, parehong seks na kasal ay hindi inaaprubahan sa Japan. Sa madaling salita, ang parehong seks live-in ay hindi makakatanggap ng serbisyong sosyal na pareho ng sa ligal na kasal.
Para sa proteksyon ng karapatan ng parehong seks live-in, may mga uri ng kontrata sa pagitan ng maglive-in.

Ang sistemang kaugnay sa parehong seks live-in sa Japan na uso sa buong bansa. Ang kamalayan sa sosyal tungkol sa parehong seks ay dapat na makahabol sa globalisasyon at para matanggap ang pagkakaiba-iba sa buong mundo. Gayunpaman, para baguhin ang kaugalian at tradisyon sa kasaysayan, ito ay nanganagailangan ng matagal na panahon.
