国際結婚が増加する中、婚姻生活の破綻や離婚に際して、一方の親が勝手に子供を自国に連れ帰ってしまう「子の連れ去り」に対応するための国際的な取り組みがハーグ条約です。
2019年時点、世界で101ヶ国が加盟しており、加盟国内で子の連れ去りが発生した場合、下記のような取り組みがなされます。
子を元の居住国へ返還
親子の面会交流の機会の確保
本取り組みに関して最大限保証すべきことは、子の利益（意思）です。
したがって、子が居住国へ戻ることを明確に拒否した場合は、返還は認められません。
とは言え、家族の価値観や家族法の在り方は各国で異なり、また、幼い子の意思が本当にその子の利益につながるのか等、検討すべき点は多岐にわたります。

With the increase of international marriage, a divorced couple take child and return his/her home country without consent. Hague Convention on the Civil Aspects of International Child Abduction is the treaty to return the child to his/her home country where he/she was born and raised.
As of 2019, 101 countries worldwide have already signed the treaty. Here are the basic guidelines of Hague Convention.
Return the child to his/her home country
Secure the opportunity for parents to meet the child
What’s most important is the feeling of children (what’s the best solution for the child?)
So, if the child clearly denies the return, it cannot happen along with the treaty.
But family values and family laws differ county to country, and we never know what the child wants is really the best solution for the child when thinking about the future. Many things have to be considered from the aspect of the culture, environment and parents right and so on.
